Digital Forms Terms
Supplemental terms governing the Front Desk digital forms and intake service.

These Digital Forms Terms ("Forms Terms") supplement the Front Desk Terms of Service ("Terms of Service") and collectively govern your use of the Front Desk digital forms and intake features (the "Forms Service"). These Forms Terms and the Terms of Service are collectively referred to as the "Terms." Capitalized terms used but not defined here have the meanings set forth in the Terms of Service. To access and use the Forms Service, you and your end users must at all times agree to and abide by these Terms.
1. The Forms Service
The Forms Service is a customizable digital forms solution that simplifies the creation of online forms — including patient and client intake forms — and the collection of information from your customers, clients, and patients. Forms may be shared by link, text message, or through your booking flow, and completed submissions are made available to you through the Front Desk platform.
2. Your Obligations
2.1 Your Forms Are Your Responsibility
You have exclusive control over, and responsibility for, the content, quality, and format of any form created or processed through the Forms Service (each, a "Form"). You are solely responsible for reviewing and editing Forms before use, for determining whether Forms meet your requirements and needs, and for ensuring that all Forms meet applicable legal requirements.
2.2 No Legal Advice
The Forms Service is a tool only. Front Desk may provide pre-built templates or assist in building Forms at your direction, but Front Desk makes no representation that any custom-built or templated Form satisfies the requirements of any applicable law, regulation, or governmental directive ("Applicable Laws"). Applicable Laws depend on your particular use case and context. Front Desk does not provide legal advice, and no Form, template, sample, or related resource should be relied upon as legal advice or as a substitute for the advice of your own attorney.
2.3 Privacy, Consent, and Data Accuracy
You are responsible for compliance with all Applicable Laws governing the security, privacy, collection, retention, and use of any personal information collected through the Forms Service, including protected health information where applicable (see our Business Associate Agreement and HIPAA Compliance pages). You agree to provide notice to any person who submits information through a Form (a "Form Respondent") that discloses how and why their information is collected and used, and to obtain all consents required by Applicable Laws. You, and not Front Desk, are responsible for confirming the accuracy of the information collected via Forms, including the validity of signatures, consents, acknowledgments, and agreements. Front Desk does not control or verify the data submitted through the Forms Service and does not guarantee its accuracy, integrity, or quality.
2.4 No Healthcare Services
Front Desk does not offer or provide medical advice, health insurance, or any other healthcare service. The Forms Service is a communication and data collection tool only. To the extent any healthcare services are offered to any Form Respondent, they are provided by you, not Front Desk, and Front Desk has no control over the appropriateness, accuracy, quality, timeliness, scope, price, or risks of any such services.
3. Intellectual Property
The Forms Service and its contents, features, and functionality — including templated Forms, software, text, displays, images, and the design, selection, and arrangement thereof ("Forms Content") — are owned by Front Desk, its licensors, or other providers, and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may access and use Forms and Forms Content solely for their intended purpose in connection with your own business use, and not for further reproduction, distribution, or resale. No right, title, or interest in the Forms Service or Forms Content is transferred to you, and all rights not expressly granted are reserved by Front Desk. Content you upload into your own Forms (such as your logo, policies, and questions) remains yours, as described in the Terms of Service.
4. Electronic Signatures and Documents
The Forms Service may be used to facilitate the execution of consents, acknowledgments, contracts, agreements, or documents (each, a "Document") between you and a Form Respondent. You acknowledge and agree that:
- Electronic signature laws and regulations may impose specific requirements on electronic Documents. You are solely responsible for ensuring your use of the Forms Service complies with all such laws, and for performing any authentication or verification of Form Respondents;
- You are solely responsible for determining whether a Document is appropriate for electronic signature. Certain document types may be excepted from electronic signature laws (for example, wills and certain family-law agreements) or subject to agency-specific regulations;
- Front Desk is not a party to any Document processed through the Forms Service and makes no representation or warranty regarding the transactions effected by, or the legal enforceability of, any Document;
- Consumer protection laws may impose special requirements for electronic transactions involving consumers, such as consent to the method of contracting or delivery of a paper copy. You are responsible for determining whether such requirements apply and for complying with them;
- Front Desk is not responsible for determining how long Documents must be retained under Applicable Law, or for producing your Documents to third parties.
5. Prohibited Uses
In addition to the restrictions in the Terms of Service and our Acceptable Use Policy, you agree not to use, or permit any end user or third party to use, the Forms Service to:
- Collect payment card data — including primary account numbers, service codes, expiration dates, card validation codes, magnetic stripe data, PINs, or PIN blocks. Payment information must be collected only through the Payments Service (see our Payment Processing Service Terms);
- Sell or advertise commercial goods or services to Form Respondents;
- Violate any applicable law or regulation, including laws regarding the export of data or software;
- Send, receive, upload, download, use, or re-use any information or data that does not comply with the Terms;
- Engage in any activity that, as determined by Front Desk, may harm Front Desk or its subscribers, expose them to liability, or threaten the security of any data.
6. Form Storage, Retention, and Deletion
Front Desk may set and enforce reasonable use limits to prevent abusive or unduly burdensome use of the Forms Service. While your subscription is active and in good standing, you may retrieve and export copies of completed Forms for storage outside the Service at any time, and may delete Forms from the Service at your discretion. Front Desk may delete incomplete Form submissions after a reasonable period, and may delete Forms (whether complete or not) upon termination of the Service, subject to any data retention obligations in our Business Associate Agreement where applicable. You are solely responsible for retaining permanent records of all Forms required for your legal, regulatory, and clinical record-keeping obligations.
7. Disclaimer
The Forms Service is provided "as is," "where is," and "as available" without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, quality, accuracy, title, and non-infringement. Front Desk does not warrant that the Forms Service is or will be error-free, will meet your requirements, or will be timely or secure. Your use of the Forms Service is at your sole risk, subject to the limitations of liability set forth in the Terms of Service. Some jurisdictions do not allow limitations on implied warranties, so the above limitations may not apply to you.
8. Indemnification
Without limiting any provision of the Terms, you agree to defend, indemnify, and hold harmless Front Desk and its affiliates, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) the reliability, accuracy, or legitimacy of data submitted or processed through the Forms Service; (b) claims by Form Respondents, including claims relating to the disclosure of personal information; and (c) any alleged or actual violation by you of any Applicable Laws.
9. Term, Suspension, and Termination
These Forms Terms take effect on the date you first sign up for or use the Forms Service and remain in effect until you cancel the Forms Service by notifying Front Desk, or until you or Front Desk terminate the Terms of Service in accordance with their terms. Without limiting the Terms of Service, Front Desk may suspend or terminate your use of the Forms Service if Front Desk has reason to believe you have violated Applicable Laws, engaged in a prohibited use described in Section 5, or if Front Desk reasonably believes your conduct poses an imminent or actual threat to Front Desk's systems or other subscribers.
10. Ratification
By accessing or otherwise using the Forms Service, you expressly acknowledge and agree to these Forms Terms in addition to the Front Desk Terms of Service.
